Preamble

The OPERATOR’s activity – carried out through the website www.infinitygift.ro is focused on providing the commercial services described in the content of this material and implies acceptance by all those who opt for the services included in the System «INFINITY GIFT TEAM» of the following GENERAL CONDITIONS (TERMS AND CONDITIONS FOR THE CONCLUSION OF CONTRACTS)
The present conditions make up the general framework governing the relations concluded with the persons and / or entities interested in contracting the services provided by the OPERATOR
EXPLANATORY STATEMENT - DESCRIPTION OF SERVICES:
The OPERATOR has developed his own system in the field of identification - based on the criteria established in advance with the consultation of the applicants - selecting (making up), packing and delivering consumer goods and / or services destined to provide on various occasions, the gratification of others, carried out through mediation of the OPERATOR from the assignment and at the expense of those interested to resort to such services.
The activity carried out within the above mentioned system, proved its viability under the conditions of a commercial exploitation based on the negotiation of the best prices in relation with the suppliers of goods and services (experience in selecting the goods and / or services offered to the recipients, as well as assistance in identifying criteria that outline their profile and guarantee discretion throughout the process).
The provision of the services «INFINITY GIFT TEAM» is based on the interest of the applicants to contract the purchase and delivery of their assignment of goods and / or services having the characteristics determined by the OPERATOR – in relation to the profile of those rewarded by this service - in compliance with the general conditions assumed by both parties once the order is launched, as well as the supplier's ability to ensure the optimal procurement and delivery of goods and services - as agreed on the basis of this agreement.
Relying on good faith and taking into account the firm intention of those interested to enter into such partnerships - in order to establish the principles of collaboration - the applicants agree to respect both the legal framework in this matter and the following GENERAL TERMS AND CONDITIONS.

Definitions / Notions

Buyer (Applicant): The natural or legal person (entity) interested - registered on the Website www.infinitygift.ro (holding an account) who places an Order under the conditions established in the stage preceding the contracting of the services provided by SC INFINITY GIFT TEAM SRL and which also assumes the specific obligations provided under the GENERAL TERMS AND CONDITIONS.
Interested person: The natural or legal person who accesses the site and has or obtains access to the content of the TERMS and CODITIONS by any means of online communication
Account: The section consisting of an e-mail address and a password intended to allow the applicant to submit the Order.
Website: Domain www.infinitygift.ro
Order: Electronic document that serves as a form of communication established between the Operator and the Buyer (Applicant) - through which the latter transmits to the Operator, through the Site, his firm intention to contract the services intended to purchase the goods and / or services offered in the form of gratification to the recipients.
Goods and Services: Any product and / or service to be provided (delivered) by the Operator through the «INFINITY GIFT TEAM» system to the person(s) indicated on the basis of the applicant's order.
«INFINITY GIFT TEAM» system: Includes services based on the purchase of gifts (goods and / or services) after launching the order and personalizing them for each client, under the slogan "Only For You!"
Recipients: Third party persons who are served by and at the request of the applicant through the services provided by the Operator - or, as the case may be, the person who applies for these services for himself/herself.
Contract: The remote contract concluded for the purpose of providing the «INFINITY GIFT TEAM» services - by placing the order - without the simultaneous physical presence of the Operator and the Buyer.
Content: All information on the Site that can be visited, viewed or accessed using electronic equipment / Content of any email sent to the Operator by the applicant by electronic means of communication / Any information communicated by any means by an employee, subcontractor or collaborator of the Operator according to the specified contact information / Information regarding the tariffs practised by the Operator in a certain period.
Transaction: Receipt or reimbursement of an amount resulting from the sale of a good or a service by the Operator - by using the services of the card processor approved by him regardless of the method of delivery.
Online payment system: the payment service provided by the payment processor integrated into the Site, made available to the Buyers through the Site in order to make an online card payment.
Specifications: All specifications and / or descriptions of Goods and Services - as determined and specified in their description.

Placing orders

Orders to the Infinity Gift team are made through the website www.infinitygift.ro, requiring the creation of an account and the provision of accurate information. Subsequently the user must choose the a package and an amount, fill out the questionnaire, add it to the shopping cart, then finally choose the payment method.
Filling in the questionnaire is important for all parties involved, thus facilitating optimal personalization of the gifts.

Delivery of orders

Once the order has been placed, the Infinity Gift team set out to identify the most appropriate experience for the recipient of the gift, starting from the previously defined profile.
Standard delivery will be done through our DPD Courier partner, between 1 and 30 days after placing the order. On the morning of the delivery, the beneficiary will receive a text message from our partner, announcing the delivery.
Special deliveries will be subject to direct talks with the buyer for establishing all necessary details.

Payment of orders

All prices displayed on the website www.infinitygift.ro include VAT. The price and the payment method will be specified in each Order. The Seller will issue to the Buyer an invoice for the delivered Goods and Services, the Buyer's obligation being to provide all the information necessary to issue the invoice according to the legislation in force.
Payment can be made on the site, directly with card through the system integrated by the Operator, by payment order in the account specified on the invoice or by cash on delivery, in the situations where the beneficiary and the buyer are one and the same person.

Product warranty

All the products delivered through www.infinitygift.ro benefit from the guarantee granted by the producers, under the conditions established by the legislation in force and in accordance with the commercial policies of the Infinity Gift Team SRL partners. The warranty certificates will be issued either by the manufacturer (partner) or by Infinity Gift Team SRL.
Security Policy for the processing of personal data
According to the provisions of Law 677/2001, INFINITY GIFT TEAM SRL, with headquarters established in Baia Mare, Transilvania Street, No. 6, Ap. 9, Maramures county, processes personal data, in compliance with the principles mentioned below, for legitimate purposes.
The purpose of this policy is to establish the necessary measures as well as the responsibilities of the employees of SC INFINITY GIFT TEAM SRL, in order to fulfil the obligations regarding guaranteeing and protecting the fundamental rights and freedoms of private persons - in particular the right to intimate, family and private life. This policy applies to all SC INFINITY GIFT TEAM SRL employees.
The processing of personal data is performed by automatic and / or manual means - in compliance with legal requirements and under conditions that ensure the security, confidentiality and respect of the rights of the data subjects. The employees of SC INFINITY GIFT TEAM SRL will access the necessary personal data, only for the fulfilment of the service duties. Access to computer systems will be made individually, based on user and password, and passwords will comply with the minimum-security rules. Passwords will not be passed on to third parties and will not be recorded on any physical medium.
The processing of personal data is done in accordance with the following principles:
• Notification - the personal data operator is notified to the National Supervisory Authority for the Processing of Personal Data;
• Legality - processing of personal data is done on the basis and in accordance with the legal provisions;
• Well-determined purpose - any processing of personal data is done for well-determined, explicit and legitimate purposes, adequate, relevant and non-excessive in relation to the purpose for which they are collected and subsequently processed;
• Confidentiality - the internal regulation for the organization and functioning of SC INFINITY GIFT TEAM SRL contains regulations regarding the confidentiality of information;
• The consent of the data subject - any processing of personal data, with the exception of the processing which concerns data from the categories strictly mentioned in Law 677/2001, can be made if the data subject has given his explicit and unequivocal consent for that processing;
• Information - the information of the persons is done by the institution that processes the personal data of the data subject;
• Data protection - the data subjects have the right of access to the data being processed, to intervene on them, to oppose and not be subject to an individual decision, as well as the right to address the National Supervisory Authorities for Personal Data Processing or the court for the defence of any rights guaranteed by law, which have been violated;
• Security - the security measures of the personal data are established so as to ensure an adequate level of security of the processed personal data.
Data subjects' rights:
• the right to obtain from SC INFINITY GIFT TEAM SRL, upon request and free of charge for one request per year, confirmation of the fact that the data concerning you are processed or not by the operator;
• the right to obtain from SC INFINITY GIFT TEAM SRL, upon request and free of charge the rectification, updating, blocking or deletion of data whose processing is not in conformity with Law 677/2001, especially incomplete or inaccurate data;
• the right to obtain from SC INFINITY GIFT TEAM SRL, upon request and free of charge the transformation into anonymous data of data whose processing is not in accordance with Law 677/2001;
• the right to oppose at any time, for well-founded and legitimate reasons, the processing of their data, except where there are contrary legal provisions; in case of justified opposition the processing can no longer target the data in question;
• the right to address justice for the defence of any rights guaranteed by this law, which have been violated; Also, to claim the non-observance of the rights guaranteed by Law 677/2001 you can address the National Supervisory Authority for the Processing of Personal Data or the Courts.

Return policy

According to the Government’s Ordinance 34/2014 regarding consumer protection at the conclusion and execution of distance contracts, the consumer has the right to notify the trader in writing that he gives up the purchase, without penalties and without invoking a reason, within 14 calendar days from the receipt of the product or, in the case of the provision of services, from the conclusion of the contract.
The products will be returned at the customer's expense. SC INFINITY GIFT TEAM SRL will return the value of the order within 14 days from the date of written cancellation of the contract, but this period can be delayed until the receipt of the package or until the client sends a confirmation that he has sent the package, taking into account the nearest date. The back amount does not include transport expenses and fees related to bank charges.
The product will be returned to Infinity Gift Team SRL at the address Baia Mare, Transilvania Street, No. 6, Ap. 9, Maramures County or at the Work Point explicitly specified, by the same means of transport used for delivery. For return, an Infinity Gift consultant will contact the client and determine the necessary details. The cost of returning the product is borne by the client and will be clearly specified by our consultant when initiating the return.
The returned products must be in perfect condition, unused or worn; the products can only be returned in the original packaging, which should not be damaged (adhesive tape stuck directly to the box, traces of blows, etc.).
In the case of products that have a seal, it must not be open; the product must be returned sealed. Products made to the specifications presented by the consumer or personalized are exempted from the right of return.
To return the devices, they must not be used, they must include all the accessories with which they were delivered, without traces of knocks, scratches, etc. The condition of the devices must be the same as when they were purchased. Any sign of wear on the packaging will result in the cancellation of the right of return.
In the case of consumable materials, the unpacking of the pack or the opening of the seal leads to the loss of the right of return.
The buyer may exercise his right of withdrawal by completing the Withdrawal Form.

According to the requirements of Law no. 677/2001 for the protection of  persons regarding the processing of personal data and the free movement of these data, modified and completed, and of Law no. 506/2004 regarding the processing of personal data and the protection of privacy, Infinity Gift Team SRL has the obligation to administer, in safe conditions and only for the specified purposes, the personal data you provide to us. SC Infinity Gift Team SRL is registered as a personal data operator at the registry of A.N.S.P.D.C.P. under number 14759 as of 30/06/2017. As administrator of the website www.infinitygift.ro, SC Infinity Gift Team SRL undertakes not to transmit the collected data to third parties and to use them exclusively for the purpose for which they were collected - the execution of the orders and the commercial communication regarding the activity carried out through the site.

Data collection

Personal data are collected only with your consent and only if they are provided voluntarily. These data are necessary for the commercial activity: invoicing, collection, delivery, service, guarantees.
According to Law no. 677/2001, you benefit from the right of access, of intervention on the data, the right not to be subject to an individual decision and the right to address the justice. You also have the right to object to the processing of personal data concerning you and to request the deletion of data *. In order to exercise these rights, you can send a written request using the contact form.

Anonymous data

Through the site www.infinitygift.ro it is also possible to collect anonymous data, inadvertently generated by users browsing the site. These data can only be processed by Infinity Gift Team SRL and, possibly, by specialized collaborating companies. The resulting information is used for the continuous improvement of the services offered through this site. At any time, you can opt to delete from the site's database the data you’ve provided.

We do not encourage spam and therefore we do not send unsolicited messages.
Our company can send informative messages regarding the activity carried out through the website www.infinitygift.ro and the current offers and promotions. These messages will be sent exclusively to the users registered on this site and only with their express consent.

Assignment and subcontracting
The Seller may assign and / or subcontract a third party for Services related to the completion of the order, after informing the Buyer, his/her consent not being necessary. The Seller will always be liable to the Buyer for all contractual obligations.
Transfer of ownership of goods
The ownership of the Goods will be transferred upon delivery, after the payment made by the Buyer, in the location indicated in the Order (by delivery understanding - signing the receipt of the transport document provided by the courier, or signing the receipt on the tax invoice in case of deliveries made by the Seller's personnel).
